South Pasadena, Calif. — The X-Law Group P.C. and Presidio Law Firm LLP, which represent residents and business owners affected by the May 2026 chemical tank emergency at GKN Aerospace’s Garden Grove facility, are responding today to the Orange County District Attorney’s announcement of a claims program of up to $100 million for the more than 50,000 residents displaced by the incident.
“A number on a press release is not the same thing as a plan,” said Carlos X. Colorado, an attorney at X-Law’s Long Beach Office. “The devil is in the details, and right now there aren’t any. Until we see how this program will actually be administered, families who lost wages, businesses that lost weeks of revenue, and residents who are still dealing with health concerns have no way to know what this really means for them.”
Key questions that remain unanswered
Both the District Attorney’s office and GKN Aerospace have acknowledged that program specifics are still being developed, with claims submissions not expected to open until fall. X-Law and Presidio Law Firm note that several essential variables have not yet been defined, including:
Eligibility criteria — Who qualifies as “impacted”? Is eligibility limited to the mandatory evacuation zone, or does it extend to the broader area affected by vapor exposure, school closures, and business disruption across the six cities involved?
Claim caps and allocation — Is $100 million a firm ceiling or an aspirational figure? How will funds be allocated if verified claims exceed that amount, and is there a per-household or per-business cap?
Categories of recoverable loss — Beyond hotel stays, meals, transportation, and lost wages, will the program cover medical monitoring, mental health treatment, property value diminution, or long-term health effects from chemical exposure?
Proof and documentation standards — What evidence will claimants be required to produce, and how will the program accommodate residents who lack receipts or documentation from a chaotic, fast-moving evacuation?
Independent administration and oversight — Who will administer the fund, and will claims decisions be subject to independent review or appeal, or left to GKN’s discretion?
Waiver of legal rights — Will accepting a payment from the program require claimants to release GKN Aerospace from further liability, including for injuries or losses that may not yet be apparent?
Funding guarantees — What assurance exists that the full $100 million will actually be paid out, and on what timeline, particularly given GKN’s pending federal and state investigations?
Interaction with existing relief funds — How will this program coordinate with the $3 million relief fund and county discretionary funds already distributed, to avoid confusion or double-counting for residents who already applied?
What this means for affected residents and businesses
“We’re glad to see movement after three months, but ‘the program is in development’ is not a program,” Colorado added. “Until these key details are fleshed out, we are simply advising our clients that we are skeptical about the legitimacy of the program, that we are looking into it for them, and that to the extent a claim is submitted it should be done through us to maximize the recovery and not waive rights.”
